At the end of its 2023 term, the United States Supreme Court upended 40 plus years of administrative law when it issued two back-to-back decisions in Loper Bright Enterprises et al. v. Raimondo, which ended Chevron deference to administrative agency interpretations of federal laws, and Corner Post, Inc. v. Board of Governors of the Federal Reserve System, which expanded a plaintiff’s ability to challenge longstanding federal rules. This panel will discuss these recent Supreme Court decisions and provide practical insights on the path forward for Clean Air Act regulation.
